As the news was first broken here on FAA News, Ocean County Superior Court Judge Marlene Ford's recently overturned Lakewood Township Planning Board's approval of Yeshiva Toras Chaim's dormitory expansion on the basis that the Township Committee has not deemed dormitories to be a permitted use in the residential zoning district and therefore the Board lacked jurisdiction to approve the non-permitted use.
The Yeshiva Administration has now retaliated against the neighbors by reporting to the Lakewood Township Code Enforcement regarding an alleged fence violation.
The fence is located in the rear yard and not noticeable from the public road or property line.
Attorney Matthew Fiorovanti Esq. who was retained by the Yeshiva Administration, wrote to Code Enforcement Director Mike Saccamano alleging that the fence located in the rear of the neighbors property "is unlawfully encroaching on the YTC property."
Mr. Fiorovanti's letter demands that the neighbors immediately remove and/or relocate the encroaching fence at their sole expense, concluding with the threat that "failure to immediately remove and/or relocate the encroaching fence will result in an appropriate application being made by YTC in an appropriate venue for all available relief, at equity and law. YTC expressly reserves all rights at law and waives none."
Curiously, the Yeshiva Administration did not actually provide a survey of the property to substantiate their claim.

Ironically, that fence was likely installed to prevent the bochurim from trespassing into the neighbors property!

The neighbors should call תורת חיים to a דין תורה.
Some of the heintike yeshivos are clearly of low caliber with how the hanhala behaves. Nebach!
