JACKSON BOARD OF ED SUED OVER SCHOOL BUS CRASH



Jackson Township resident Robin Diaz has just slammed the Jackson Township Board of Education with a civil lawsuit over a school bus crash.


The crash caused her "permanent, personal injuries," the complaint alleges.


According to the complaint filed in New Jersey Superior Court in Ocean County by Philadelphia Attorney Jonathan A. Fendler, Esq.:


On January 18, 2022, Diaz, was operating a motor vehicle, traveling eastbound on Bennetts Mill Road, near its intersection with Frank Applegate Road/Butterfly Road, in the Township of Jackson.


At the time, Tara Molnar was operating a school bus traveling southbound on Frank Applegate Road, near its intersection with Bennetts Mill Road.


Southbound traffic on Frank Applegate Road is regulated by a stop sign and flashing red signal while eastbound traffic on Bennetts Mill Road is regulated by a flashing yellow signal.


For reasons unknown, the school bus driver came to a stop at the stop sign on Frank Applegate Road before attempting to continue straight, southbound, onto Butterfly Road without yielding to cross-traffic on Bennetts Mill Road. In so doing, she entered the intersection and forcibly collided with the front of the motor vehicle operated by Diaz, as Diaz lawfully traveled through the intersection.


The Defendant, Molnar, failed to maintain control of her vehicle, causing injuries to Diaz.


Molnar, did so carelessly, recklessly, and negligently operate a motor vehicle resulting in injuries to Diaz.


As a result of the acts and/or omissions of the Defendant, Tara Molnar, Plaintiff, Robin Diaz, sustained diverse personal injuries of both a permanent and temporary nature, endured and will endure great pain, has been and will be compelled to expend large sums of money for physicians and other help in an attempt to cure Plaintiff’s said injuries, has been and will be prevented from attending to Plaintiff’s normal business and affairs, and has been otherwise damaged.


The complaint also names as defendants the Jackson Township Board of Education because:


Defendant, Tara Molnar, was employed by Defendant, Jackson Township Board of Education, and was acting within the course and scope of her employment.


The negligence and carelessness of Molnar is imputed upon the Board of Education by and through the doctrine of respondeat superior, as the employee was engaged in conduct while acting in the course and scope of her employment with the Board of Education.


As a result of the acts and/or omissions of the Board of Education, Diaz sustained diverse personal injuries of both a permanent and temporary nature, endured and will endure great pain, has been and will be compelled to expend large sums of money for physicians and other help in an attempt to cure Plaintiff’s said injuries, has been and will be prevented from attending to Plaintiff’s normal business and affairs, and has been otherwise damaged.


The complaint demands judgment against Molnar and the Board of Education for such sums as would reasonably and properly compensate Plaintiff in accordance with the laws of the State of New Jersey, together with interest and cost of suit.


The defendants have 35 days to answer the just filed complaint.


The Jackson Board of Education is currently also involved in another personal injury lawsuit.


As previously reported here on FAA News, the Board of Education is fighting a lawsuit filed by Kristopher Kertes, a minor, who was injured while falling off of the monkey bars on the playground of Crawford-Rodriguez Elementary School.


Jackson taxpayers will be on the hook to defend these lawsuits.
