Khal Bnei Yisuschur, is set tonight, Thursday, May 23, 2024, to seek approval from the Toms River Township Zoning Board of Adjustment to legalize its operations.
Known formally and fondly as KBY Learning Center, "The Shul for Everyone," which holds multiple minyanim throughout the day and night, is represented by Attorney Donna M. Jennings Esq.
The proposal would result in the consolidation of 1767 Whitesville Road and 186 Jumping Brook Drive to allow for the operation of a house of worship with an accessory residence.
The application is seeking the following relief:
• Preliminary and final major site plan approval
• Conditional use variance from Ordinance Section 348-9.5, to deviate from a conditional use standard with respect to minimum distance of the house of worship from the side property line (an existing condition)
• A use variance and/or a bulk variance from Ordinance Section 348-5.9, if deemed necessary, to permit more than one principal building on a lot containing a single-family dwelling
• Bulk variances from Ordinance Sections 348-5.8, 348-8.4, and 348-8.20 to permit deviations with respect to: (a) maximum height of an accessory building, (b) minimum size of the buffer along a property line abutting a residential use, (c) to allow parking and a principal structure in the buffer area, (d) to allow parking in the front yard where same is prohibited, and (e) minimum buffer required along a street frontage which abuts areas zoned for residential use (if deemed necessary)
• Bulk variances from Ordinance Section 348-10.5, if deemed necessary, for existing conditions, with respect to: (a) minimum rear yard setback for an accessory structure and (b) minimum side and rear yard setbacks to a residential property line for an accessory structure, which shall remain the same
The board began hearing the KBY Learning Center proposal at their last hearing on May 9, 2024.
The Board will continue the public hearing tonight, Thursdav, May 23, 2024 at the Toms River Township Municipal Building, located at 33 Washington Street, Toms River, New Jersey 08753, beginning at 6:30pm.
As previously reported here on FAA News, the Zoning Board is also considering an application to use a house at 162 Stevens Road as a shul.
Due to the overcrowded agenda tonight, that application will be postponed to June 13.
These two shul applications are the first in Toms River since the township lowered the minimum acreage for a shul in order to avoid litigation with the U.S. Justice Department.
