REINA FILES LAWSUIT CLAIMING LOSS OF ENJOYMENT OF LIFE




Michael Reina and his wife Laura Reina have just slammed Home Depot with a lawsuit over personal injuries which he claims "incapacitated [him] from pursuing normal employment," and caused him "loss of enjoyment of life."


Reina, who serves as mayor of Jackson Township, filed this lawsuit in his personal capacity, not as mayor.


Reina is represented by Toms River Attorney Timothy J. McNichols, Esq. of the firm of Dasti, McGuckin, McNichols, Connors, Anthony & Buckley. The firm also serves as general counsel to the Township.


According to the civil complaint just filed in New Jersey Superior Court in Ocean County:


On or about July 14, 2022, while shopping at Home Depot in Freehold, an item fell from a shelving display unit and struck Reina, causing him to sustain severe injuries.


At the time, Reina was a business invitee lawfully upon the premises, and Home Depot U.S.A., Inc., as the owner and operator of the premises was responsible for the supervision, design, construction, maintenance, control and repair of the premises.


The defendant, Home Depot, U.S.A., Inc., was legally responsible for the safety of its customers, and supervision of its agents and employees to ensure customer safety on the premises upon which Reina was injured. Home Depot carelessly and recklessly breached said duty by failing to warn, inspect, and otherwise ensure that Reina would not be struck by falling merchandise, which was a reasonably foreseeable dangerous condition due to Home Depot's chosen business model.


The defendant, Home Depot, U.S.A., Inc., was negligent and careless in that it caused and permitted unsafe, dangerous and hazardous conditions, and defects to exist on the premises, failed to warn of such defects, failed to make proper inspection, wrongfully caused Reina to come into contact with such defects and was otherwise inattentive, careless and negligent.


As a direct result of the negligence of Home Depot through its employees in the manner in which they negligently owned, operated, supervised, designed, constructed, maintained, controlled, inspected, stocked, and repaired the premises, Michael Reina was caused to sustain severe injuries when an item fell from a shelving display unit and struck him, causing severe injuries.


As a direct and proximate result of the negligence and carelessness of Home Depot, Michael Reina suffered permanent injuries whereby body part(s) or organ(s) or both, have not healed to function normally and will not heal to function normally with further medical treatment, which injuries required medical treatment, caused pain and suffering, disability and impairment and the loss of enjoyment of life and incapacitated him from pursuing normal employment and other usual activities and will in the future require additional medical treatment and result in continuing pain and suffering, disability and impairment and loss of enjoyment of life.


As the direct and proximate result of the negligence and carelessness of Home Depot, Laura Reina, has and will in the future be required to provide extraordinary services and care and has and will in the future be denied the aid, comfort, companionship, society and consortium of her husband Michael Reina.


The complaint demands judgment either jointly, severally, or in the alternative for damages, together with counsel fees, interest and costs of suit, together with any and all other relief as the Court may deem equitable and just.


The suit demands a trial by jury on all the issues so triable.


Home Depot has 35 days to answer the complaint.
