A frum Lakewood resident has just slammed Monmouth Medical Center Southern Campus (formerly known as Kimball Hospital) with a medical malpractice lawsuit.
According to the complaint just filed in New Jersey Superior Court in Ocean County by Newark Attorney Margo Zemel, Esq.:
At all relevant times, the Plaintiff was a 20-something year old young woman with extremely good looks, for whom appearance was very important. Among other things, of particular importance to the Plaintiff was her smile, which was perfect.
At or about the timeframe referenced in this Complaint (December 2022), the Plaintiff was in a serious dating relationship with a man to whom she would very soon become engaged and marry.
On or about December 1, 2022, the Plaintiff fainted. In doing so, she hit her face and sustained a broken jaw and issue with her front tooth. She was transported to and treated at Monmouth Medical Center Southern Campus. She was examined in the emergency room by Dr. Jimenez.
In the Emergency Department, the Plaintiff’s jaw and mouth was not examined by either Jimenez or anyone else. Because they did not examine it, the Defendants failed to detect and inform the Plaintiff that she had not lost her front tooth - it was embedded in her gumline.
Had the Defendants examined the Plaintiff’s jaw/mouth, they would have discovered that the front tooth was still there, intact, and could be simply pulled back into place.
Unbeknownst to the Plaintiff, there was only a small window of time within which to restore the tooth, and after which it was lost. As a result of the Defendants’ failure to properly examine the Plaintiff, the Plaintiff had to undergo an implant to replace the front tooth.
When the Plaintiff sought dental help, it was too late to save the tooth, which had to be extracted. She underwent surgery in which a bone graft was placed in order to provide a place to anchor an implant.
Because an implant could not be placed for at least three months after extraction, the Plaintiff had a “flipper” tooth customized to place in the space left in her mouth that had to be taken out and put back in at various times. Her teeth had also shifted with the loss of the front tooth, and her jaw had to be realigned through the use of Invisalign.
Because the Plaintiff’s teeth had to be shifted, and because the bone graft and gum had to heal, the Plaintiff was still without an implant by October 2024.
As a result of the Hospital’s failure to locate and pull back into place the tooth, the Plaintiff spent $20,000 in dental costs, with an anticipated additional $5,000-$7,000. When the Plaintiff got married, she had to wear her “flipper” tooth.
The suit alleges Professional Negligence - At all relevant times, the Hospital and Jimenez owed the Plaintiff the duty of exercising reasonable care in examining each patient coming into the Emergency Department thoroughly and specifically. In breach of that duty of care, the Hospital and Jimenez failed to thoroughly examine the Plaintiff in the areas of her obvious injury. As a result of the negligence of the Hospital and Jimenez, the Plaintiff suffered injury in that she ended up losing her front tooth.
The complaint - which demands trial by jury as to all issues - seeks judgment against the Hospital and Jimenez "jointly and severally, for damages."
The hospital and doctor have 35 days to answer the complaint.

We need to either sue that hospital out of existence, or have it taken over my medical experts who know what they are doing.
It is a shande that we have so many medical askanim, and nothing can be done about having an acceptable hospital in town.
