Lakewood Cheder School has recently filed a lawsuit in federal court alleging that the solar system installed on their site is in a state of disrepair and may require $450,000 in repairs, FAA News has learned.
The suit contends that the solar contractor, Hudson Energy Solar Corp., now doing business as MN8 Energy LLC, is responsible to do these repairs and is now in breach of their contract.
Lakewood Cheder is represented by R' Aaron (Arthur) Law Esq., a musmach of Beth Medrash Govoha who has selflessly dedicated many years of fighting for fairer school aid funding for all of Lakewood’s students.
According to the complaint filed in U.S. District Court of New Jersey:
Lakewood Cheder School, Inc. contracted with Hudson Energy Solar Corp., a power provider in Ramsey, New Jersey, for an array of photovoltaic panels, trackers and equipment to be installed on their site at 725 Vassar Avenue in Lakewood.
The contract includes repair and maintenance until 2026.
The system has been in a state of disrepair since August 23, 2023.
The Yeshiva has been in prolonged discussions with the contractor and has been demanding repair of the system. The contractor has admitted during those discussions that the equipment is 80% down and only producing 20% of capacity.
The contractor has told the Yeshiva that repairing the panels would cost around $450,000.
In all this time however, the contractor has not done the necessary repairs.
Due to their solar system being in disrepair, the Yeshiva has been force to draw energy from the common electric grid at an extra cost of approximately $12,000 a month.
The complaint seeks damages for breach of contract and unjust enrichment.
The contractor has 35 days to answer the complaint.

Contractors who work for schools are effectively being paid by the collective apparent body by means of their paying tuition. Not honoring a commitment is thus stealing from the רבים. Any practicing Jew would be cognizant of the aforementioned and remedy the situation.
