TAKE NOTE: TOEIN SUED FOR SLANDEROUS STATEMENTS MADE IN BAIS DIN AGAINST HIS ADVERSARY



A just filed lawsuit puts Toeinam on notice - you can face legal action for slanderous statements you say against your adversary!


According to the complaint filed in court, a husband and wife were going through divorce proceedings in bais din. During the arbitration session, the husband's toein began fabricating an illicit relationship between the wife and another man. The toein referred to the other man as the wife's "boyfriend."


The lawsuit, filed by the "other man" alleges that the toein's statements were: i) Slander Per Se; ii) Intentional Infliction of Emotional Distress; and iii) Fraud.


i) Slander Per Se - The toein's false statements accused Plaintiff of adultery and incest. These statements were spoken out loud in front of esteemed figures in Plaintiff’s tight-knit community, diminishing his reputation among his peers and elders. These statements were only emitted in an attempt to diminish and harass the plaintiff and the wife. As a result of the aforementioned actions, Plaintiff suffered substantial harm.


ii) Intentional Infliction of Emotional Distress - The toein by act intended to inflict emotional distress upon Plaintiff via false statements of adultery and incest by espoused directly to the Arbitrator and all present. This conduct was intentional, malicious, and done to cause Plaintiff and the wife to suffer humiliation, mental anguish, loss of reputation, and emotional and physical distress. As a consequence of the toein's acts, as hereinabove alleged, Plaintiff suffered severe humiliation, mental anguish, loss of reputation, and emotional and physical distress.


iii) Fraud - The toein provided statements in the arbitration session alleging blatantly false accusations of adultery and incest between Plaintiff and the wife. The toein intentionally disseminated misinformation to diminish Plaintiff and the wife in the eyes of the Arbitrator and close-knit community in order to tip the outcome of the Arbitration in the husband's favor. The toein intended for the Arbitrator to rely on these false statements in his determination of the Arbitration Award. As a consequence of the toein's acts, as hereinabove alleged, Plaintiff suffered severe humiliation, mental anguish, loss of reputation, and emotional and physical distress.


The suit demands judgment against the husband and his toein for unspecified compensatory damages, together with interest and cost of suit.

Another case of both sides being wrong.
A person may not slander someone else.
The person who was slandered may not steal money from the slanderer through courts.
