VITO CARDINALE VOWS TO SUE JACKSON TOWNSHIP AFTER COUNCIL VOTES TO BLOCK POSSIBLE DEVELOPMENT PLANS

The Jackson Township Council on Tuesday night voted to enact an ordinance to modify the Township's Highway Commercial Mixed-Use Zone (HCMU) zone.


The HCMU zone includes those areas generally located on the south side of County Route 537 between the Interstate 195 corridor and the Hurricane Harbor Water Park.


The existing ordinance permits residential uses other than detached single-family dwellings with the "maximum number of dwelling units is four units per gross acre, including affordable units."


The new Ordinance modifies this to permit "four units per acre dedicated to residential use."


Council President Jennifer Kuhn explained that the Adventure Crossing development already has approvals for 460 residential units as well as numerous commercial uses including hotels and medical and educational components; the property is now being marketed for sale as "perfect for 1,200 residential units," and the Council wanted to ensure that the promised commercial uses aren't changed into more residential apartments, thus the new Ordinance was created.


Vito Cardinale, the developer of Adventure Crossing voiced strong opposition to the ordinance, noting it targets only his project.


Engineer Ian Borden, who did not tell the Board who he was representing, stated the ordinance was vague and irregular as it didn't include a "purpose."


After his presentation, Cardinale vowed "to sue the Township for $120 million" if they adopt the ordinance.


Councilman Scott Sargent was the sole "no" vote, citing the need for additional affordable housing and Borden's point that the ordinance was vague and Cardinale's point that the ordinance targeted him.

Cardinale may be losing a lot of money at Adventure Crossing, judging by being behind in property taxes. Low income high density housing may be one way Cardinale can reduce the losses. Jackson is a lawyers dream because of the constant lawsuits.
