CONFLICT AT TOWN HALL? LAKEWOOD DEPUTY MAYOR'S VOTE UNDER FIRE AS APPEALS COURT TAKES UP BANQUET HALL CASE



The New Jersey Appellate Division has just scheduled oral argument for February 25, 2026, in the high-profile legal challenge to Lakewood Township’s controversial ordinance allowing banquet halls as an accessory use in schools.


While the case raises numerous procedural and zoning issues, the appeal squarely spotlights Points Two and Three of the lawsuit, which allege a serious conflict of interest involving Lakewood Deputy Mayor Menashe Miller.


According to the complaint, Miller should have been barred from voting on the ordinance because of close family ties to schools operating — or positioned to benefit from — banquet halls. The lawsuit alleges that Miller’s sons attend, or recently attended, a yeshiva with a banquet hall, and that his mother holds a significant administrative role at another school operating one of Lakewood’s oldest banquet halls.


Critically, the appeal argues that without Miller’s allegedly tainted vote, the ordinance would have failed, rendering its adoption invalid and requiring it to be overturned.


Ocean County Assignment Judge Francis Hodgson dismissed the lawsuit in July 2024, but the Appellate Division’s decision to hear oral argument signals renewed scrutiny — particularly of the ethics and voting integrity issues raised in the appeal.


Beyond zoning law, the case underscores a broader concern: the importance of ensuring that municipal officials remain free of conflicts at town hall, especially where ordinances are likely to spark litigation and risk reversal. A finding that a conflicted vote carried legislation could have far-reaching implications, not only for this ordinance but for future governance and public confidence in local decision-making.


A written decision from the Appellate Division is expected sometime after oral argument.

interesting that at the next meeting their is a ordinance to cancel taxes for some schools. I winder if it has to do with the halls? who can we contact to find out?
