SIGNING BEIS DIN ARBITRATION AGREEMENT LANDS FRUM MAN IN JAIL



If you are served a Hazmanah (summons) to a New York Beis Din and you fail to respond, the worst thing beis din can do is issue a Siruv (contempt order).


If you do respond and you sign an Arbitration Agreement, you can eventually land up in jail!


In one developing story, a frum man signed an Arbitration Agreement to adjudicate a divorce in a New York beis din. Subsequently, his estranged wife  arbitrarily alientaed the innocent children from their father. In response the man withheld giving a get.


The bais din issued a psak (ruling) requiring the man to give a get. 


The woman sought enforcement of this ruling to the New York Supreme Court. As a result, a judge recently threw the man in Rikers Island for contempt of the order!


The judge stated at sentencing: He is remanded. He is found in contempt and is remanded. The purge condition is that he gives the wife the gett. Sir, you will be in jail... and you are going to stay there until you rot unless you give her the gett."


Notably, the Appellate Division denied an emergent application to stay enforcement of the order.

No way this is true separation of church and state. This would also probably be considered a get Meuseh. What probably happened was there is also a monetary judgement that the husband refused to pay like child or spousal support. The ex wife probably agreed to release the obligation if he gives the get

No you only land in jail if you refuse to abide by the agreement you committed to!
