Following four contentious public hearings, filled with numerous neighbors represented by two attorneys, the Lakewood Planning Board on Tuesday night memorialized its approval of a new duplex development which could add 300 cars to Prospect Street and Massachusetts Avenue.
The final Site Plan is for the construction of thirty-six duplex structures (seventy-two dwellings plus basement apartments), two playgrounds, and a shul. All the units will be accessed through a new cul-de-sac roadway off Massachusetts Avenue which is to be known as Adirondack Way.
The original plan, submitted by Keypoint Equity LLC, provided secondary access through the existing High Point driveway easement onto Prospect Street. However, the High Point property owners, represented by Attorney Vincent DelRiccio, argued this new development has no legal right to traverse the easement. Therefore, the final plan eliminates this secondary access way.
Numerous other neighbors retained Attorney Ron Gasiorowski to oppose the project on multiple grounds.
Ultimately the Board aproved the project, with the following conditions:
1. The applicant shall revise the site plan to include a 5th parking space for all residential units, with the exception of those units located along the cul-de-sac where space constraints prevent the addition of the 5th spot.
2. The applicant shall move the proposed park at the end of the cul-de-sac back to create space for additional parking stalls.
3. JCP&L must approve the proposed streetlights within the Shade Tree & Utility Easements.
4. The proposed stormwater management system out letting towards Sterling Place must retain the 100-year storm.
5. Mr. Weisman shall have the opportunity to review the compliance submissions.
6. The applicant shall condense and push back the secondary park area as necessary to maximize additional on-site parking stalls in that vicinity.
7. The applicant shall obtain formal Fire Department approval during the resolution compliance process.
8. The applicant shall legally deed the HOA parking lot to the Homeowners Association with a restrictive covenant ensuring it is used exclusively for park purposes and no other use.
9. All proposed signage shall strictly comply with all applicable municipal ordinances.
10. The applicant shall design the shul entranceway and parking configuration to address Board concerns regarding pedestrian safety, specifically ensuring that parking and traffic flow do not creates hazards for children utilizing the adjacent playground.
11. The applicant shall design the entryway of the playground to minimize safety conflicts.
12. The HOA park lot shall be dedicated strictly for use as a park and this will be memorialized via a deed restriction during resolution compliance, provided to the satisfaction of the Board engineer and Board attorney.
13. The applicant shall provide shielded lighting and work with the Board engineer and JCP&L during resolution compliance to lower light poles at their standards.
14. The applicant shall install a 6’ chain-link fence with vinyl slats at 10’ from the rear property line and provide 3 rows of evergreens along the fence.
Back on March 30, 2022, Yehuda Dachs on behalf of Lennox Group, LLC purchased this vacant, nearly ten acres parcel on the east side of Massachusetts Avenue, about 700 feet south of Prospect Street behind High Point for $9.9 million.
Residents have 45 days to file an appeal with the Superior Court.
