The family of Batsheba B. Kohn, a frum teenage girl who perished last year in a car crash on Route 70 in Lakewood, has just filed a lawsuit against the driver seeking unspecified monetary damages, FAA News has learned.
According to the complaint just filed in New Jersey Superior Court in Ocean County by Roseland, NJ attorneys Paul M. da Costa and Mitchell A. Dornfeld Esq.:
On May 9, 2023, Kohn was a pedestrian lawfully ambulating southbound along Vermont Avenue and walking across State Highway 70 within a marked crosswalk.
At the time, Brian G. Phungtran was operating a motor vehicle - which was owned by defendant Steven V. Tran - and traveling westbound on Route 70.
Phungtran operated his vehicle in a grossly negligent, careless and reckless manner in that he failed to abide by posted and known speed limits; faied to maintain a proper lookout and make proper and reasonable observations; failed to operate the vehicle under adequate control; failed to operate the vehicle with due caution and circumspection; and failed to bring his vehicle to a stop before striking Kohn, resulting in her ultimate death.
The 3-count complaint seeks for judgment against the driver and owner of the vehicle for compensatory and punitive damages together with interest, costs of suit, attorneys fees, and such other relief as the Court may deem equitable and just - not only for medical and funeral expenses, but also for future earnings and loss of her advice, guidance, companionship and counsel.
The suit demands a trial by jury.
The defendants have 35 days to answer the complaint.
